The defandant was charged with Impaired and Over 80. The prosecutor had concerns that they would be able to prove the identity of the defendant as the driver. As a result, a resolution was reached whereby the two criminal charges were withdrawn and the defendant was allowed to plead guilty to the Highway Traffic Act offence of Careless Driving . The defendant was put on a term of probation where, for 1 year, he could only drive for work purposes. As a result of this resolution, the young defendant avoided a criminal record and also was able to maintain his job which required him to be able to drive in order to fulfill his duties.
