The defendant was charged with Over 80. Prior to trial, I served a constitutional argument on the Crown arguing that the defendant’s right to counsel had been infringed. Prior to trial, the Crown agreed to withdraw the criminal charge. Instead, the defendant was allowed to plead guilty to the Highway Traffic Act offence of Careless Driving for a fine and no suspension of his driver’s licence. This resolution also avoided a criminal record for the defendant.
