The defendant was charged with Over 80. During the course of the trial, the officer’s evidence raised the possibility that he had not used the roadside screening device in a proper manner. Rather than chance an outright acquittal, the prosecutor agreed to withdraw the charge and allow the defendant to plead guilty to the Highway Traffic Act offence of Careless Driving. He was fined and his driving privileges were limited for nine months but he was able to continue driving for work purposes. As a result he was able to save his job and avoid a criminal record.
